A Bismarck man who police say shot his young nephew in the chest with a BB gun now faces two felony charges in Morton County.



Tyler Ross, 20, is charged with aggravated assault and child neglect, court records show.


The boy who was shot on June 23 told authorities he was taking apart a cardboard box in a northwest Mandan residence and Ross told him to hold up the box, according to an affidavit. Ross allegedly fired the BB gun and the projectile went through the cardboard, into the boy’s chest and lodged between two ribs, police said.

It wasn't clear what prompted the alleged incident. The boy and his sister initially told authorities that the injury occurred while they were playing outside -- that Ross was shooting at a target and the boy was shot when he ran behind it. Both later changed their story, telling authorities the injury occurred while the boy was holding up the box inside the home.


The boy is younger than 8. He was taken to a Bismarck hospital and later transferred to Fargo. Authorities didn't provide further information on his injury.


Court documents don’t list an attorney for Ross. He’s in custody pending $5,000 cash bail. He made his initial court appearance Thursday and will enter pleas later. South Central District Judge Cynthia Feland ordered Ross not to have any contact with his nephew. No further court hearings were immediately scheduled.

Reminds me of the kid who thought you could stop a bullet with a phone book and strapped it to his chest and made his gf shoot the gun to test. Sometimes I wonder if God stopped handing out brains or just to a select few.

I'm glad when my brother and i would play the game of shooting at each other playing cowboys in the trees with our Red Ryders back in our younger days that they were worn out Red Ryders and not whatever he had. Dumb ass.

But they still would hurt when hitting open skin and glad folks did not feel the need to get us help for having clean fun between the two of us. However not sure if they ever seen us at those moments and never did shoot out an eye. But he came close to my eye one time. Right between them but i got him good with a sling shot. Dumb kids even if we did put jackets on to play.

Might have taken the gold metal back then. db

The guy is an idiot thats for sure. I always have a little scepticism about gun stories. If the BB was lodged between the ribs it's not like it was lodged against the heart. I'm surprised that Bismarck had to send himo Fargo. Something about this we still don't know.

There certainly is no shortage of idiots that is certain. A couple years ago a group of college freshmen went out for opening day of duck season. My grandson was in a boat when approached by a half dozen. They were about 30 yards away when a coot swam between them. One fellow lifted up his shotgun and everyone was hollering don't shoot, but he did. The steel BBB went through my grandson's right eye, all the way through the head, but under the brain, and is lodged in bone next to the brain stem. To close for doctors to operate. The BBB is steel so he will never be able to have an MRI.

Had a case of a drive by bb gun shooting that ended in a fatality. Teen was charged with murder. Golden rule of guns, only point at what you want to kill. Unfortunately there is no fixing stoopid.

Sounds like not just a toy BB gun,today it's a break action 1500ps BB/pellet gun combined with whiskey dumb ass decision,one always thinks what could've happened after an event like this,young man/boy is darn lucky he didn't lose an eye...

My brother was shot in the eye back in the 70's while were playing (racing our tricyles in the driveway) and neighbor kid and his dumb ass friend were pointing a bb gun at us, eventually hit my brother in the eye. Luckily, in the 80's he was seen by a specialist and they were able to restore his vision in that eye ( not 100%) Folks took his folks to court, sued their ass, but was only able to get 6 or 8 grand out of the them at the time, in the 70's, that was a decent haul, but not enough if you ask me.

Likely just an idiot, better ways to educate him than spending 100k + of taxpayer money incarcerating him.... A bunch of community service and a fine should suffice.

Now that is when a big lawsuit should be filed and won. Would be deserving in this case.
