Except as set forth in subsection</span></p><p><span style="font-family: 'sans-serif'">2, the following factors must be considered when determining whether a reasonable person hearing a noise resulting from the operation of a boat or other watercraft would find the noise violates this section:</span></p><p><span style="font-family: 'sans-serif'"></span></p><p><span style="font-family: 'sans-serif'">a.The volume of the noise;</span></p><p><span style="font-family: 'sans-serif'"></span></p><p><span style="font-family: 'sans-serif'">b.The intensity of the noise;</span></p><p><span style="font-family: 'sans-serif'"></span></p><p><span style="font-family: 'sans-serif'">c.Whether the noise is unusual;</span></p><p><span style="font-family: 'sans-serif'"></span></p><p><span style="font-family: 'sans-serif'">d.Whether the origin of the noise is natural or unnatural;</span></p><p><span style="font-family: 'sans-serif'"></span></p><p><span style="font-family: 'sans-serif'">e.The volume and intensity of any background noise;</span></p><p><span style="font-family: 'sans-serif'"></span></p><p><span style="font-family: 'sans-serif'">f.The proximity of the noise to residential sleeping facilities;</span></p><p><span style="font-family: 'sans-serif'"></span></p><p><span style="font-family: 'sans-serif'">g.The nature and zoning of the area from which the noise emanates;</span></p><p><span style="font-family: 'sans-serif'"></span></p><p><span style="font-family: 'sans-serif'">h.The population density of the area from which the noise emanates;</span></p><p><span style="font-family: 'sans-serif'"></span></p><p><span style="font-family: 'sans-serif'">i.The time of day or night;</span></p><p><span style="font-family: 'sans-serif'"></span></p><p><span style="font-family: 'sans-serif'">j.The duration of the noise; and</span></p><p><span style="font-family: 'sans-serif'"></span></p><p>k.Whether the noise is recurrent, intermittent, or constant.<span style="font-family: 'sans-serif'">2.An individual who creates a noise exceeding eighty-eight decibels by operating a boator watercraft between the hours of ten p.m. and seven a.m. is in violation of section</span></p><p><span style="font-family: 'sans-serif'"></span></p><p><span style="font-family: 'sans-serif'">1.The noise must be measured at a distance of twenty-five feet [7.62 meters] from the</span></p><p><span style="font-family: 'sans-serif'"></span></p><p><span style="font-family: 'sans-serif'">source of the noise.</span></p><p><span style="font-family: 'sans-serif'"><span style="font-family: 'sans-serif'">5.An individual who violates this section is guilty of a class</span></span></p><p><span style="font-family: 'sans-serif'"><span style="font-family: 'sans-serif'"></span></span></p><p><span style="font-family: 'sans-serif'"><span style="font-family: 'sans-serif'">2 noncriminal offense.</span></span></p><p><span style="font-family: 'sans-serif'"><span style="font-family: 'sans-serif'"></span></span></p><p><span style="font-family: 'sans-serif'"></span></p><p><span style="font-family: 'sans-serif'">Examples of noise that my violate this 88db restriction listed below...</span></p><p><span style="font-family: 'sans-serif'"></span></p><p><span style="font-family: 'sans-serif'"></span></p><table style='width: 100%'><tr><td>Boeing 737 or DC-9 aircraft at one nautical mile (6080 ft) before landing (97 dB); power mower (96 dB); motorcycle at 25 ft (90 dB).
