I saw that same article and was wondering what the hell they were getting at. There is no way they can stop people from trimming their own trees, so I think the article is just poorly worded in that it should have said "thou shalt not hire someone else to trim your tree unless they are a certified arborist".

If not, then there were literally hundreds of people breaking this law over the past few days.

It is unlawful for any person to do commercial tree pruning or removal within the City without a commercial license to do so, except if such person is part of a crew or group working under the direct and immediate supervision of the holder of a commercial license.

Pay close attention to the words " commercial tree pruning or removal " they are referring to someone who does it for hire and is not for the home owner that choses to do it themselves, unless the trees are on public right away.

The way its written is defin open to interpretation.

It is unlawful for any person to do commercial tree pruning or removal within the City without a commercial license to do so, except if such person is part of a crew or group working under the direct and immediate supervision of the holder of a commercial license.

Now does commercial pruning include your own property? My guess is if your being paid its commercial so as long as not being paid yoir in the clear?

Only if you film it, put it on YouTube and get enough hits to generate income. For a tree-trimming video to generate those kind of hit numbers though, you'd probably have to damage things bigly and would still end up $$$ way behind.

13-02-05. Removal and Trimming of Trees and Shrubs by Owners. No person owning or occupying any real property within the city shall permit any trees, shrubs, or other vegetation located on such real property or on any public right-of-way abutting such real property to overhang or obstruct any public sidewalk, street, alley, or other public place in a manner that endangers or interferes with the reasonable use of such public sidewalk, street, alley, or other public place. The city forester may serve a written notice upon the owner or occupant of such real property requiring the trimming or removal of such trees, shrubs, or other vegetation within a specified time. If the owner or occupant fails to comply with such notice, the city forester may cause the trimming or removal to be done and the expense thereof shall be a charge against such owner and a lien upon the real property, to be assessed and collected as a special assessment.

a guy I know in bismarck was told recently, supposedly by someone that works for the city, that he is required to remove branches from trees that were overhanging his neighbors property, not a public space, or alleyway or anything like that, and these branches were pretty high off the ground. This doesnt seem reasonable to me.

This doesnt seem reasonable to me.
Was it his tree overhanging into the neighbors property?

More and more rules. I get the city tryimg to protect people from fly by nighters that are just trying to get money but man at some point a little common sense...eventually we are gonna have rules on how much we can shit or piss and which bathroom in the house we can use.

Could it be that they're trying to prevent the spread of disease? Along with stopping all the "fly by night" guys who swoop in to make a buck? I know the guy we hired were very careful with our elm trees, only certain time of year and disinfected the saws before trimming the elms.

It was over the property line, but branches were fairly high off the ground. He was told that if he doesnt cut the branches, the city would do it for him and charge him for it, but it wasnt close to any lights or utilities or overhanging a public space, seems like BS to me. Seems to me that large trees often go over property lines.
