North Dakota Outdoors Game and Fish magazine February 2017 edition reported on page 21:

Nonresidents may dark house spearfish in North Dakota "IF" they are from States that offer the same privilege for North Dakota residents.

Call it a privilege, courtesy, or decency, I feel it is the correct thing to do with fishing seasons too.
