Holy moly...I'm laughing because I'm pretty sure this is something I learned by watching late-night crime dramas... you know "you need a warrant for that."

Illegal search and seizure...tsk, tsk, tsk.

Dude caught red handed shooting a deer with a rifle in a shotgun zone gets off Scott Free because someone at the MN DNR forgot to brush up on Law & Order.

I don't get it. If they got a tracking warrent but that doesn't alow them to put a tracking device on his car. What does a tracking warrent allow?

The only thing I can gather is they got a tracking warrant, but not a search warrant. But even the tracking warrant didn't allow them to use it for what they needed it for??

Methinks the defense had a darn good lawyer, too.

An expensive defense attorney shopped around and found a liberal judge. Happens all the time. They did have a warrant, which was approved by the county prosecutor and a different judge. Even the ruling judge said it contained sufficeient probable cause and the DNR did nothing wrong. Those are his actual words in the ruling. The newspaper article does not give the whole story. (shocking, I know!) I would suspect that this will be appealed and the DNR will win.

Interesting that they have to return the animals that were obviously illegal. I can see dismissing the charges if that's warranted but returning illegal contraband doesn't seem right. Do we return cocaine to a drug dealer even if a judge rules against the prosecution in a similar case as this?

In Mn rural farming communities we have a homestead sitting on every quarter section,hence shotgun only zones even then we here stories of a shotgun slug hitting a house or garage,further out in western minn we have maybe one homestead sitting on a section and our liberal state still recommends shotgun only.

does shotgun include muzzleloader? What is the difference in range between a rifled shotgun with slug and a standard rifle? Id think with shotguns being less accurate, that would increase risk a bit also, no? I just know Id be pissed of I was told I cant hunt with my rifles anymore....

I hunted in a shotgun only zone in northwestern mn growing up and it was fine. The last shotguns that we used before they switched it to a rifle zone would shoot 1" groups at 100 yards pretty easily. The farthest anyone in our group shot a deer was 225 yards verified with a laser range finder before he shot it. They are not as bad as what a person thinks if you have a gun specifically for that purpose and they hit like a hammer.
