Ebert though being in "serious medical condition" said the shooting was an accident and he "didn't want to pursue charges," according to the affidavit.<h3></h3>Duran was providing lifesaving measures to Ebert when police arrived at the East Divide Avenue apartment about 6 p.m., the affidavit states.Witnesses told police the men had been drawing their weapons on each other before Ebert was shot. There were discrepancies in their accounts "as to whether they felt there was no ill will between the pair," according to the affidavit.The felony charge was filed against Duran on Wednesday. He faces a possible five-year prison term if convicted.
