A man accused of accidentally shooting another man at a Bismarck apartment allegedly told police he knew the shotgun was loaded before he and the other man engaged in a game that included drawing their weapons on each other, according to an affidavit.

Timothy Duran, 19, of Mandan, is charged with reckless endangerment, court records show. Police say he and William Ebert, 23, of Bismarck, had pointed weapons at each other three times Tuesday in a game Duran said they also had played in the past, the document states. Ebert was shot in his lower left abdomen when the shotgun Duran was holding discharged, according to authorities.
Duran denied the shooting was intentional but said he knew the gun was loaded, according to the affidavit. He allegedly told police he loaded it about 15 minutes before pointing it at Ebert, police say. Ebert though being in "serious medical condition" said the shooting was an accident and he "didn't want to pursue charges," according to the affidavit.

Duran was providing lifesaving measures to Ebert when police arrived at the East Divide Avenue apartment about 6 p.m., the affidavit states.

Witnesses told police the men had been drawing their weapons on each other before Ebert was shot. There were discrepancies in their accounts "as to whether they felt there was no ill will between the pair," according to the affidavit.
The felony charge was filed against Duran on Wednesday. He faces a possible five-year prison term if convicted. Court documents don't list an attorney for him.
Ebert was in stable condition at Sanford Health on Wednesday afternoon, according to the hospital.
