There’s more of the story. the two DNR guys had it out for Hoffman just by how excited the second one got when he realized who it was. Even after they knew they had fucked up they doubled down and still tried to prosecute. I agree but why should spotlighting be illegal if nothing is shot? What harm is done by shining a light on a deer at night? Do we arrest people for thinking about doing something now?

I don't think it is UNLESS you have a gun with you. But still, at night you may not know what the hell it is out there. I'd guess if ever challenged by the SCOTUS or even a State SC, it be declared unconstitutional.

In the video posted, he didn't even use a spotlight. He stopped and looked at it with his binoculars. Apparently, in that state, it's illegal to stop and use your headlights to look at a deer if there's a gun in the truck. The wardens even admit that they couldn't be sure he turned to use his headlights to look at it. He'll make some money on the lawsuit. It sure sounds like they put that deer where they knew he'd at least put some light on it so they could arrest him.

Busted as in "gave him a ticket"? Busted meaning arrested? Or busted as in "wanted to talk to the guy in a tux for a few minutes to see if he was DUI and let him go with a warning?".

My in-laws have an 80Ac hobby farm in central MN. I swap to brights and sweep the field on both sides of the driveway every time I get there no matter what time of year, what season is on, and no matter whether I have a gun in the vehicle or not. I don't want to hit or even have a close call with a deer driving up the highway. Sometimes I'll stop w/the deer directly in the brights and honk the horn to get them to stay away.

Sounds a bit like they were set up specifically for this guy as they made mention of him shooting a big deer.
