Federal removal of state gun laws?

I've been loosely following this topic for a little while now. I didn't think there was much chance of it passing before, but it is starting to look like it has legs. For those who haven't been paying attention, this is Congress' attempt to make all states recognize each other state's concealed carry permit holders.

Basically, this puts the control of gun ownership, concealed carry, and restrictions in the hands of the federal guberment, and I have to admit that I am not a fan of that. We'll be Australia and Canada before you know it.

i am not sure i agree with the take on that issue. sure its a federal firearms law. but, there are already plenty of those on the books. does this law do more than force other state's to recognize another state's CWP?

I am guessing it's the pre-cursor, or impetus to the feds setting the standards for concealed carry.

ND is one of the easier places to get a concealed carry (recently made moot), if the feds oversee it...we and our gun friendly/similar states don't have the political pull in DC to prevent the rules from getting out of control.

I was thinking the same thing. I don't really see the negative if there isn't a lot more to it. If you live in ND and head to Illinois, you can still carry your sidearm. Sounds handy in Chicago.

The "Hook" is that this administration, or ANY administration thinks they have the authority to ignore the Constitution and decide who can have guns and who can't. The 2nd amendment already provides for the very thing this piece of legislation and the authors of this bill want us to THINK they will GIVE us. Think about it. Instead of this additional layer of bureaucracy, lets just go with the Constitution and get rid of the vast majority of gun laws that have never kept one gun out of the hands of a criminal.......EVER.

My ND CWP expires in June of this year, with the new law that went into effect, should I or do I need to renew my ND permit or not? I also have my Utah CWP, will I still have to have my ND permit to get my Utah one renewed or will the new law cover that?...............Sorry Allen, for high jacking your thread.

tikka, if I were in your shoes I would renew your ND permit. If I'm not mistaken, there are some states that would not recognize your utah permit if you don't have an ND permit. Besides that, the ND class 2 permit has reciprocity with 25 states while the class 1 has reciprocity with 39 states. The Utah permit actually only has reciprocity with about 30 states anymore. The only thing that really bothers me about the ND Class 2 permit is that Minnesota does not recognize it. If you plan to carry in Minnesota, the Utah permit will do you no good as well as MN does not recognize the Utah permit either. The only one they recognize is the ND class 1.

Tikka. I renewed my ND class 2 because constitutional carry has a few issues
I believe there is a glitch in the ND constitutional carry were you are not allowed to have a loaded weapon in a motor vehicle.
With constitutional carry you are required by law to let the Officer know that you have a gun or could be charged. This could have been an issue for my wife when she was driving my truck and didn't know I had a gun in the center console, she also has a CC.
Constitutional carry only covers guns and not other weapons

the renewal is easy I would recommend renewing

Obi, the constitutional carry law does in fact allow for the concealed carry of a loaded firearm in a vehicle. This was clarified by Stenehjem in an opinion he issued on 12-14-2017. You are correct about the notifying law enforcement officers about the weapon though. I don't know about you guys, but I myself choose to start the conversation out with "Officer, before you start, I am a conceal carry permit holder and I want to inform you that I have a pistol in the vehicle, it is located _______."

No problem. BTW, I renewed mine right after tbe state went to constitutional carry. What I am not sure of is the purpose behind doing so, other than the already in place reciprocity agreements.

i will admit, i've done no digging. and i kind of assume allen has.

Not as much as I probably should, I just don't like congress reeling in all the responsibility with the knowledge of how many reps sit in Congress from such gun-loving places as New York, Illinois, California, etc.

. i agree with letting the officer know but like I stated before it is when someone is not aware of the gun like my wife was is when you could be in trouble.
i did not hear about stenehjems opion, thanks for the update

There is a nice free app for your phone. It's simply called Concealed Carry Laws. Some states you tell the officer your carrying, and in some you don't. Anyway, it's updated and has good information.
