While I'm totally onboard with stuff like this, someday, someone is going to complain about the check points. Just like what people do with DUI checkpoints. Unless someone is being suspected of committing a crime, they don't have any authority to just stop a motorist from traveling.

Not in SD, you agree when purchasing the licence to submit to checks.

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Again, I like the idea that poachers and violators get caught. Drives me crazy when I hear about people overharvesting fish or game, but I think just like DUI checkpoints, eventually someone is going to get educated enough to put a stop to these.

I don't think it's unreasonable when you've been pursuing game that is owned in "public trust" that you are subject to checkpoint stoppage. As Rowdie said, buy the license, you've agreed/submitted to the search.

Yes, as a matter of fact it did begin with checkpoints, "papers", and cops harassing Jews. And Grizzly Adams did have a beard.

I don't think it's unreasonable when you've been pursuing game that is owned in "public trust" that you are subject to checkpoint stoppage. As Rowdie said, buy the license, you've agreed/submitted to the search.

As far as I know, DUI checkpoints have been ruled acceptable due to public safety. I don't believe game checkpoints cross that threshold. I won't be writing my legislator anytime soon on the matter but I'm not completely comfortable on the idea.

Personally I think our personal liberties are more important than catching a few extra game violators. There are other ways to catch poachers that dont infringe upon the general publics freedom...

Now I know that in ND, there was a amendment to the State Constitution, which makes hunting a 'right'. But in SD, its still a privilege, not a 'right'. IF you CHOOSE to buy a licence in SD, you then AGREE to the terms and conditions set by the State.

Now I know that in ND, there was a amendment to the State Constitution, which makes hunting a 'right'. But in SD, its still a privilege, not a 'right'. IF you CHOOSE to buy a licence in SD, you then AGREE to the terms and conditions set by the State.

I like the amendment idea, believe ND got that right. I believe checkpoints would still be legal in ND, especially if was stipulated in the regs that you submit to being checked.

buying a hunting license doesn't throw your constitutional rights out the window lol

What about the folks who didn't buy a hunting license being cattle through a check point, grandpa didn't buy one, isn't hunting, just headed home to the farm. He sure didn't agree to any random stop.

I have no problem with them. The couple I have been through had a guy on the road before the turn off to the lot looking for only people that were hunting. They only brought in people with camo or orange on.

I went through a check point the first Sunday of deer season at the bridge going out of mandan on highway 6. Guy asked if I'd been hunting today and I said yes. He asked if I had anything in the back, I said just some luggage from the weekend. He said "thank you, have a nice day". I did see that he had a mule deer buck head in the back of his truck though.

I laugh at the guys that said " it takes up to much of my time". ;:;rofl If you are in that much of a hurry to get somewhere that 5 to 15 minuets of time stopped at one of these is causing you a problem, then maybe you should sit down in front of a mirror, and have a long conversation with the person your looking at, and rethink the lifestyle you are living. I have nothing against them as if you are doing nothing wrong or illegal then there's nothing to stopping and getting checked , and be on your merry way.

Ah yes the "This is my rights issue" I think the way the world has gotten, you people that think it against my rights to be searched are in for a rude awaking, as every time you go to a sports event, a concert, a fair , a public meeting, or any other place a big group of people gather, be prepared to be searched. It all stems from the wackos in the world today.

Ok you don't want to stop or waste time being search at a game checkpoint. So we just raise everyone's taxes so we can pay for more wardens to protect the game that is owned by the public (not the land owner). ::: I think?

It really surprises me how many unlawful sportsman are out there. Until the punishment is enough to make someone even think twice about what they are doing things won't change. Start taking guns, trucks, boats, and lifetime privileges. I do 5 mph over the speed limit because I comfortable with the punishment.

There's an idea I can get behind. No checkpoints, more wardens (yes, it will cost money), and stiffer penalties. If you're not poaching game who cares how hefty the penalty is? Throw the book at 'em.
