Everybody working back then could easily be in their 70's or 80's, or pushing daisies. All paper medical records filed who knows where, or tossed in the dumpster. Pretty impossible to mount any type of defense, and as much as it sucks sometimes, everyone of us is entitled to a defense. It's right there with the 2nd amendment we all love and cherish.
As far as not trusting nurses there SVN, I trust a more experienced RN than an inexperienced doctor. You ever watch a good 4 year RN steer an ER doctor to the right diagnosis?

If one was sent home with the town millionaire and the other with the town drunk, not saying this happened but just think how both their lives would have been different if they were sent home with their real parents. $ 50,000 may not be enough

what type of defense could they mount even if it was discovered 35 yrs ago ? the babies were sent home with the wrong parents, whether intentional act or incompetence the hospital is still liable for the fuck up and for the actions of all their employees.

I think it would be handy if every person was assigned a bar code, embedded as a microchip under their skin. That would solve a lot of these problems.
how do you know that hasn't already been happening for decades ?

50k is just a starting number to get a jury trial.

Within minutes/seconds they put the scannable bracelets on my kids and mom/me and that was how long ago.

Its going to be tough case to win, they are trying to skirt around the medical malpractice so they can go beyond the 6 year statute. My question is the ID tag -- one of them still possessed his orginal wristband that features wrong biological family name. What is to prove that they didnt give it to the other guy once they lawyered up. It will be interesting. AI says the hospital will win We will see.

Can the Statute of Limitations Be Extended?​

In some situations, yes, North Dakota law allows an extension of the statute of limitations. Here are some of the most common examples.

Discovery rule. We mentioned North Dakota's discovery rule above, in connection with the medical malpractice statute of limitations. But it's not limited to malpractice cases. The discovery rule applies to PI cases generally. When you don't discover your injury at the time it happens, the statute of limitations clock starts running on the earlier of the date you discover the injury, or the date you should have discovered it had you been reasonably diligent. (See BASF Corp. v. Symington, 512 N.W. 2d 692, 695 (1994).)
