what type of defense could they mount even if it was discovered 35 yrs ago ? the babies were sent home with the wrong parents, whether intentional act or incompetence the hospital is still liable for the fuck up and for the actions of all their employees.

Its going to be tough case to win, they are trying to skirt around the medical malpractice so they can go beyond the 6 year statute. My question is the ID tag -- one of them still possessed his orginal wristband that features wrong biological family name. What is to prove that they didnt give it to the other guy once they lawyered up. It will be interesting. AI says the hospital will win We will see.

What if the parents bought the exact same baby clothes, blankets and baby carrier at the exact same store in Grafton and accidently switched kids in the lobby while the moms were being signed out and the dads were warming the cars up to go home? What if a drunk uncle switched them in the nursery thinking it would be funny, then passed out and forgot he did it? Shit, I guess the hospital does have a defense.
