BISMARCK, N.D. (KFYR) - Charges have been dismissed without prejudice in the case of former North Dakota Game and Fish Director Terry Steinwand.
According to Cornell Law School, to dismiss without prejudice means the court has closed the current case. However, the entity or person who initiated it has the chance to re-file, make changes or bring the same case back up later.
It is not a final judgment.
The 72-year-old man was facing a Class AA felony of gross sexual imposition.
The State of North Dakota and his defense attorney had proposed two plea deals to Judge Marina Spahr, which she rejected.
In the filing, the Court states that this might look contradictory to its decisions, but
“the dismissal reflects the State’s exercise of its prosecutorial discretion, not a ruling by the Court on the merits of the case.”
