If the landowner admits to setting the trap, then its game over, he is liable. My point was the landowner could simply say that a trespasser must have set the trap and he is cleared, unless they can somehow prove who set the trap. I'm not a lawyer but seems to me would be hard to prosecute if you have no proof who actually set the trap
If people could keep their mouth shut it might be that easy, but we all know people have to brag and eventually they brag to the wrong person. Or in today's world they video it and post it on social media!

So what if you warned the potential intruder that there very well may be booby traps on the private land. Put the disclaimer right there on the posted sign. Is the land owner still liable?

ill agree there a difference but answer this...would the trespasser have been injured had he not been illegaly trespassing??? case closed in my opinion.

Nope, but that's not how the law works.

What if the "trespasser" were a lost 5 yr old girl that wandered away from her family's lake house just over the hill in search of her missing puppy? Does that help clear up why the law is pretty dead set against landowners putting indiscriminate booby traps on their property?

I'd hazard a guess that legally it's even more of a slam dunk that the landowner goes to prison. He wouldn't even have any kind of "it weren't me defense".

Allen is absolutely right. The world we live in now.. I wouldn't booby trap the land. Have you looked at "enterstupidlawsuitnamehere" lately? Burglar is up on your roof, falls through and breaks his neck. Any two-bit lawyer is going to get your nuts in a sling. This absolutely sucks, and I am absolutely disgusted by it, but if you think you can do it and just pretend it didn't happen, yet you're the landowner... Yikes, you better either have hella-good insurance, or you better already be broke.

Part B of above is the other thing. Every guy figures he'll do it and just shut up. And eventually, somebody catches wind of it, and a cop gets tipped, and the parents of the 5 yr old girl who got disfigured come after you.

It sucks, but it is the way it is now.

I wouldn't set up anything like that because of the liability, but that video is pure gold;).

I was amazed that anyone carries a rag big enough to clean up that much paint. Well, maybe I do if I include the roll of TP that I most always carry. Don't think that would be very efficient for cleaning paint.

Jaykay, you are more than likely right about your top paragraph but if a burglar fell through my roof, broke his neck, and I got sued, I would officially be the next “Gordy Khal”. Maybe not a good comparison as the circumstances were different but that kind of sh#t is what turns an honest man into a wanted man.
