If the Missouri separated the 2 states rather than the weird invisible line they have now, western Dakota would kick way more ass than eastern Dakota.
.

that is a fact i would agree with

Oh oh chalk one up for the north

- - - Updated - - -

Members of the public would set up villages of ice shacks, drive their vehicles on the ice, camp on the ice and, according to the landowners, fire guns, blare music, operate loud machinery, get drunk, litter, cookout, etc.,” wrote Supreme Court Justice Lori Wilbur in the court’s opinion. “The Landowners claimed that, on certain days in the spring and fall, over 200 boats would launch into the waters. In the winter, over 70 ice shacks and vehicles would be present.”

Isn't this nice. A comparison between 2 states that has remained pretty civil and hardly a negative comment. Most are pointing out the good points of each state instead of running each other down. I like discussions like this.

Me too even though I am a victim of a cruel drive by of a shot by the negative rep gangsters. For trying to stir the pot which was never my intention becuase it's nice to know what is not always shared. So, I called my priest he said turn the other cheek. I am glad it's stayed civil to but it most likely the ones who like a pissing match have me on thier ignore list which is not a bad thing.

http://listen.sdpb.org/post/summer-committee-passes-legislation-open-non-meandered-lakes
A special summer study committee is passing legislation to open up several of South Dakota’s non-meandered bodies of water that closed following a recent state Supreme Court decision.

The committee to regulate non-meandered bodies of water passed the bill 13 to 2, which opens non-meandered bodies of water unless landowners close them. The bill is now up for full legislative consideration.

State Senator Brock Greenfield is a co-chair on the committee. He says there are many issues the bill doesn’t address.

“Those things can be dealt with in the future," Greenfield says. "This gets us to a point, hopefully, by which we can provide the lady from The Bait Box, and a whole lot of people on Main Street, and a whole lot of sportsmen some access, hopefully in the immediate future. And also provides landowners, law enforcement, sportsmen, etc., some clarity as to what the lay of the land is.”

The bill reopens non-meandered bodies of water to hunting, fishing, swimming, boating and trapping. The bill allows negotiations between landowners and South Dakota Game, Fish, and Parks to facilitate access to water over private property.

Lawmakers removed Reetz and Highway 81 East and West lakes from a list of waters that must open.

The bill requires South Dakota Game, Fish, and Parks to present the stats on those negotiations to a legislative committee in the summer of 2019.

The bill has a sunset clause to expire on July first, 2021.

It’s widely expected the governor will call a special session if there’s support for the legislation. A date has not been set yet.
Just FYI, they have now included meandering lakes that can be closed off by land owners(81 lake was taken off the list, so now it can be closes without public input, just like the rest now). If the water went beyond the "high water mark" they can close the water. How in the world can they prove where the mark was is beyond me. Their isn't 1 document that proves the line within 10 yards at the time of survey. Just so everyone knows. Several lodges and private landowners that charges to gain access, do NOT pay tourism tax, even though by sd law. They have to. I have looked up several guides and lodge, and private landowners that i know charge over 1k for fishing rights, and not a one paid the tax. Source: sd treasury . And just so everyone knows, a landowner can close anybody of water, and we the public(water is to remain in the public trust , the use to be determined by the trustees, legislatures, source: supreme court ) have NO say anymore if the water is closed, once its closed its closed and only that landowner has rights to that public water. They can apply to have it closed but we have no way to appeal that application.!!! We must email sd reps and be polite!!!! and stick to the facts from the supreme court, and remind them that this bill gives the landowners trustee power and that is against the Scourt ruling and will lose in court this year. If you think this is just about fishing your wrong, its about drinking water down the road. This bill sets precedence for drinking water rights.
This is what happens when you don't fix stupid right a way

South Dakota limits the number on non-resident waterfowl hunters. Wish ND had the sense to do that! Might save a trip to SK every fall.

Another thing is non meandered water can be closed to the public if access is only through private land. The land owner doesnt have to give a reason to close to the public. Just think of all those little lakes the sdgf have stocked over the years all closed to public unless those lakes can be accessed via public access. That is one law ND doesn't care to have either. That just sucks for you guys down there in South dakota

they wont stock little lakes unless there is public access you have to have an easement wrote for multiple years. Most of the lakes in question now were not lakes before 97 i was walking them deer hunting with my youth tag so this is some thing rather new that needs to be sorted out. Its just taken this to get the ball rolling

My neighbor does that too. Corn leaves blow in all the neighbors yards every winter. Yup, corn every year. Not to mention I would guess within a couple weeks he will choke me with herbicides. Why is the wind always west when he sprays? Hard to get angry with him though since we have known each other for years, served on church council together, started a new church together, and for some reason I'm always driving down the road when he is broke down and walking. Oh, and I usually chase out the four wheelers that come from town and stupidly cut across his crop when it's just coming up. Now if he would just wait for an east, south, or north wind.

According to the article some lakes that were stocked have public boat access but for some reason this new ruling has made it easier for farmers to close off these becuase now the sdgf has no jurisdiction over lakes. Giving the land owners permission to close a lake if they wish.

SD's no trespass laws would have probably prevented some of the recent protest cases from being dismissed...
That should get the ball rolling.
Wife just drew an any elk tag, that's pretty cool. She's had a prior cow tag. I've had 5 tags including two cows, since being down here. Big game license opportunities are hard to beat here. I wish the west didn't have pheasants, we'd have a lot fewer Sconis.
Kurt, looks like I'm on for archery elk in Wyoming, my wife's elk in the hills, then Idaho rifle elk. Not gonna be at work much once mid September arrives!
