not that I agree with trespassing but I think this landowner could be opening himself up to legal issues or a civil lawsuit if a trespasser received injuries

not that I agree with trespassing but I think this landowner could be opening himself up to legal issues or a civil lawsuit if a trespasser received injuries

so if someone trespasses on my property and steps on glass, nails, gets a cut, infected thus resulting in loss of limb im liable, hahaha that's laughable.
its pretty simple don't trespass on other people property unless giving permission

obviously i dont know this whole story, but if you are illegally trespassing your bascially entering at your own risk and must accept that.

If I remember correctly, there was a case in Bismarck where a burglar injured himself while breaking in and sued and won....?

In ND, if land is not posted, the land owner is not liable if someone is injured while hunting.

the landowner admitted it, the guy had been warned before but sounds sketchy. Charges were filed on each side but sounds like all will be dismissed. There is a follow up article linked in the the article posted above.

Trespassing on the same land 6 years in a row takes a serious abundance of bravery and a severe lack of grey matter

A landowner setting booby traps is a far different scenario than someone illegally trespassing and getting injured by something that is an accident. Landowners setting booby traps are in great peril of becoming non-landowning members of the general public by the time a good lawyer gets done with them.

Prosecute for trespassing - yes
Preparing illegal booby-traps - no

Landowners setting booby traps are in great peril of becoming non-landowning members of the general public by the time a good lawyer gets done with them.

Prosecute for trespassing - yes
Preparing illegal booby-traps - no


Yep, plenty of people in prison right now for setting spring guns on their own property.

If the landowner admits to setting the trap, then its game over, he is liable. My point was the landowner could simply say that a trespasser must have set the trap and he is cleared, unless they can somehow prove who set the trap. I'm not a lawyer but seems to me would be hard to prosecute if you have no proof who actually set the trap

ill agree there a difference but answer this...would the trespasser have been injured had he not been illegaly trespassing??? case closed in my opinion.

Tell ya what.I would be pissed as hell some knot head come walking thru my property on opening deer season,"Oh I'm not hunting your property just the next section over" well tough shit,you were told to keep out now deal with your new paint job on you and your firearm.Hahaha.
