BISMARCK, N.D. (KFYR) - Charges have been dismissed without prejudice in the case of former North Dakota Game and Fish Director Terry Steinwand.

According to Cornell Law School, to dismiss without prejudice means the court has closed the current case. However, the entity or person who initiated it has the chance to re-file, make changes or bring the same case back up later.

It is not a final judgment.

The 72-year-old man was facing a Class AA felony of gross sexual imposition.

The State of North Dakota and his defense attorney had proposed two plea deals to Judge Marina Spahr, which she rejected.

In the filing, the Court states that this might look contradictory to its decisions, but “the dismissal reflects the State’s exercise of its prosecutorial discretion, not a ruling by the Court on the merits of the case.”

Kept inching closer to trial day, and if the family doesn't want to put the child through a trial at this time, there is nothing anyone can do about it. No victim or eye witness testimony equals no case. No way the court could tap the gavel on those plea agreements either. NO WAY. At least everyone sees him for the MONSTER he is now. The crime was reported, the statute of limitations clock is still ticking.

Yes you are, it's all the States Attorney and has no spine. When you have a confession and the Judge does not take a plea deal. You drop the case. Does Stindwand have pictures of the State Attorney screwing a goat

Looks like steinwand and the state’s attorney both run with the holmberg gang. If the plea deals would have been reasonable instead of get out of jail fee cards the judge would have accepted them. Now he will be charged with a minor misdemeanor and skate with minimal repercussions and future charges will be not possible with double jeopardy

There have been multiple similar cases in the past where the state has dropped charges to get out of the way for federal prosecution. The West Fargo principal comes to mind. Cass county announced they were dropping charges, everyone gets pissed not knowing the feds were taking over and the feds dropped the hammer on him. Nobody has gotten away with anything yet. This could be far from over.

So what? Do you honestly think any of those federal wildlife guys will have anything to do with a federal criminal child sex investigation of him? Right here in my hometown a guy was accused of molesting a young girl and in the course of the investigation was found with child porn. The states attorney let the federal government take the porn case and the guy is now doing 20 years in federal prison for that. Pretty common for child molesters to watch child pornography. I was just hoping out loud that something similar is happening with Steinwand. It's a stretch to hope, and an even bigger stretch to think any federal fish and wildlife buddies will help him. Deep down I hope everyone abandons him and he sends himself to hell.
