I always have wondered when you hear someone say "he has to live with it for the rest of their life" if the person making the statement really knows the individual they are referring to. There are some persons that could care less about the misfortune of others and will justify anything. Just because you have a conscience or a moral compass does not mean everyone does. At 50 years old, he should have known better. Hang him high.

I agree with you gonefishing. I don't know tom. But he doesn't sound like a person without a conscience. These types of cases are hard for me to rectify in my mind. Tom was clearly reckless and it's definitely criminal. So punishment is needed. But, to what level, I don't know. The harder cases to rectify are the ones where the accident is caused by the non drinker but the drinker gets hung out to dry because they were over 0.08% & were in the wrong place at the wrong time. One thing is for sure... he is gonna serve some time and his family will be financially ruined.

I find threads like this rather interesting. Especially since I know a LOT of the guys on here who are posting. And I have a tough time believing that any of those posting on this have never driven a boat or a vehicle drunk. Everyone makes posts like they're holier than thou. But I bet every single poster here at one (or more and possibly a LOT more) occasion couldn't be in Tom's very shoes if things had turned bad for them. And I bet every single one of you would be trying to do everything possible to stay out of prison and wouldn't be saying we need to set an example blah blah blah. Not condoning what happened. Just tired of reading the hypocracy. But then I guess that's the way things are nowadays. The laws supposed to put the hammer down on everyone but that "special" you.
I don't drink so I don't have a problem with them hanging him up by his nuts

I'll assume then from the pedestal you've placed yourself upon that you've never driven too fast, talked or texted while driving, or about anything else where a mistake could have put you in the same position.

you'll have to point out where I said that. We have all done dumb stuff when we were young and stupid. That no longer is the case. However, there are some that remain stupid well into their golden years and beyond. It isn't rocket science. Drink, Drive, Go to jail.

Any updates on this story, doesn't seemed to be much about the passengers or the case in general.

Fundraiser this Saturday, Sept. 19th at the Memorial Building in downtown Devils Lake. It was to be held at one of the local watering holes but evidently response has been great so they moved to a larger location. Posters around town show that it will be pretty much an all day and evening kinda deal. Free will offering for lunch,free will offering for supper, 50/50 tickets, bake sale, silent auctions( some very nice items I might add), live auction at 9pm. If you are looking for something to do for the day or evening..please consider attending.
From what I understand..both young men are still in GF hospital. The one young man I understand was upgraded from critical to serious. He has undergone some surgeries for broken bones and lung issues. The other young man is still in critical condition as his injuries are more brain related. From what I know, I believe he is making slowly but surely progress. Anybody else know more, please give an update.
The road to recovery for these young men will be long. Give them your thoughts,prayers, and perhaps a dollar or two. The costs will be enormous.
Be safe out there folks!
