I own land with very good deer habitat on it and i have never had a issue with the problem you are whining about. Yes, i have people driving by a lot during rifle season i just dont let it bother me anymore. 99 percent aren't the people you are allegedly dealing with, have you taken your harris waltz signs down yet?

Maybe we need a law that any landowner who denies a lawful hunter entry to recover legally killed game be charged with wanton waste?

I would have fought this since during deer season, a hunter is legally allowed to enter private property unarmed to retrieve a wounded animal. Unless I'm wrong precedents has been established during hunting season to deter game to go wasted where as a game warden who witnesses this shot could give a ticket to a hunter for not legally retrieving the wounded deer even though it's on posted property.

I can't believe this thread is still going. Weaver, what county is this rampant illegal activity taking place? I would like to pull up the court docs to see how often this is being reported or prosecuted. If you aren't turning these people in then you are part of the problem. It wouldn't take much of a detective to figure out if they actually shot an animal that made it onto your land or are just trespassing. Get the license plate and call the sheriff, that easy. Have you ever hunted out west? There are many stories of people legally shooting elk and deer on public land that die on private land. The landowners in many cases will not give them permission to retrieve them and the animal is left to rot. We don't need that here.

Did the warden let you keep your tag?
Just curious if he made you give up your season, guessing he could have?

John Arman had it happen to him and his daughter on one of his hunting show episodes. She arrowed a buck, it died across the fence, and the landowner next door told them to get bent. Warden and I believe sheriff had to go back and forth for a day or two to figure out the legal path forward. Eventually they figured the law and century code favored the hunter, and they went in with the warden and got the deer. Of course it was rotten but she tagged it.

Worst part is.., always seems to be a " big buck" involved.
I give my neighbors a 50 yards retrieve 【 zone】.
Gotta call me first.
I've trailed 100s of deer/ bear. Purdy confident I can look at a blood trail and know how it's gonna end up within a short span.

Controversial subject I understand. Been on both sides many times.

I can see your point, but would guess 95%+ are legit people wanting to recover their animal.
The OP story is so out of left field, I really don't believe most of it.

I'd only be for wanton waste fines if the deer was clearly dead and landowner was refusing any retrieval. That's clearly wanton waste.....no?

This happened to a good friend of mine. He arrowed a buck that ran onto someone else's land. He could actually see it dead with his binocs 100 yards across the fence. He tried to do the courteous thing by knocking on the door and letting them know. The crazy bitch wouldn't let him retrieve it and the warden/sheriff weren't able to gain him access either. He went back after dark and drug it out of there to get his deer. This happened 20 miles south of Mandan.

You have every legal right to retrieve a dead deer on posted land, its only a matter of courtesy to notify the landowner. But it is not mandatory
It's also illegal to shoot a deer in the row if the land is posted, majority of who hunt understand these laws when they recieve their deer tag in the mail, but to us this is a reoccurring situation is highly suspicious to me. Taken game in north dakota is the most humane and ethical recourse to population control, in other states deer populations have become a public nuisance.
