One more section line question

Side note:
I did talk to the game warden in our area this morning and he said a section line ends when you hit the slough. The line does not go around the slough.
I asked if he hear the word cartway before. Said he never hear that word before and has no ideal what it means however the section line ends at the slough. Twenty five years ago a game warden told me the same thing.
In my life I have acquire certain things that can upset me. One is when a person puts a badge on his chest, a gun on his hip and thinks he will sit on the right side of Jesus when he gets up there. Now he may be right but then he may not.

So I got two guys that are die hard Viking fans. I have a bet with them for the next game each at 10 dollars. I have the Eagles and the odds are against me but then on any given Sunday. I stated how many times have we gotten our hopes up for those Viking only to end in disappointment. I then showed them the trophy case of a team that went to four super bowls. A kicker who missed only one field goal all year and a quarter back who last throw was an interception. I can not lose as if I end up paying the 10 dollars I will still win. Just like getting in a fight at 70 years of age. No matter what, in the end I will come out on top. db

The bet I won but it has become apparent the money is not going to transfer my way.

But after a few hours of looking I have found the cartway rule has been repeal. I ask why and it was stated to me that not all rules made fit the situation and so they get repeal and left, in this case, to the township board or county commissioners to decide using common sense.
Section lines in general are public fairways. The boards will then decide if it makes sense to allow the public fairway around a slough.

so how do you find out which ones have a cartway? sounds to me like that's a bad bad deal

I assume none of them have a cartway any more.
So before when I was issue a ticket for leaving the section line to go around the slough and unto posted land, I have no ideal what defends I would have now. It sure as hell will not be decided by the township board at that moment.
I ask the guy would not case law from previous issues, as I am sure it has come up before when there was a law, decide this even if the law was repeal. He did not know.

It has maybe been a waste of a few hours of my life but it has been interesting to go back to 1866 when the law said that section lines are open to the public.
And then in 1973 a guy by the name of Small wanted to go down section lines to get to his 2500 acres but was told no by the neighbors and the commissioners in Bismarck agreed with the neighbors. But in time a judge told the neighbors to open the fence up as one can use a section lines for public travel and that the commissioners had no say in this.

So in the end if I had land I would probably block my section line off with no road if it serve some kind of personal agenda for me. Depending on who has the final say and how hard it gets pursue by someone I would maybe win. But not sure what I would win in the end. However, if need be, my wife/kids can hire the people who carry my casket. db
