The property owners who put a fence on their property lines must have gotten special permission because there is also a utility easement that extends on to their property.
You can put a fence on a utility easement, but not permanent structures. Most city lots have utility easements along the side and/or rear lot lines, but everyone fences to the property lines.

Burleigh County commissioners back off proposed OHV ditch ban​

BURLEIGH COUNTY, N.D. (KFYR) - Burleigh County commissioners are backing off on a proposed ban on off-highway vehicles (OHV) in county ditches, but said changes could still be coming.

Commissioners voted 4–1 not to move forward with an OHV moratorium resolution. They also voted 3–2 not to adopt the proposed ordinance amendments, which would have banned OHV use in county ditches.

They did approve a seasonal ban on ditch riding from Dec. 1 through May 15. The penalty tied to that seasonal ban is a $750 fine and applies only to riding during that time frame. The motion passed 3–2. Snowmobiles are not included, and agricultural and commercial use would be exempt.

Commissioners also debated whether changes would take effect soon enough to prevent more damage.

At one point, Commissioner Schwab said, “I’m going to tell you something right now. This is not, absolutely not going to work.”

They are waiting until the next meeting to discuss further options, such as raising penalties on the current ordinance.

Any countywide restriction, similar to a burn ban, would require a vote at a regular or special commission meeting.

The commission will continue the conversation at its next meeting on May 6.

I watched some of the puplic forum on this: what a crazy bunch of BS! 3 or 4 meetings where this topic took up most of the time. If the tracks in the ditch is such a big deal, then decide something, and put it to bed! Remember, dragging your feet might scuff up some grass!!

It should be all or non not pick which class they are going to exempt from their rules. regulations should not pick winners and losers they should be straight across the board. The snowmobile clubs pushed for their exemption while the avg kid gets the kick in the nuts. How is a side by side going to do more damage to the frozen possibly snow covered ground than a snowmobile will ?

I just might have to go to a certain area N of Bismarck next winter with my studded 97 ZR snowmobile and make repeated runs in the ditch in front of a special someone's home.

Here's my take. The ditches are not designed as trails. They are for water shed. If you want to ride the ditches fork over some money and create a trail system. This doesnt mean use it as a motorcross track as they are mostly being used for now. At least the snowmobile club makes a trail designates crossings with stop signs for most and very little damage. If the oh community wants to ride then create a trail system and maintain it. It would help to regulate your own community. If you see someone acting stupid say something.

Does the snowmobile club groom the trails in the ditches in the winter?
Some ditches have groomed trails but not all ditches. If this is about groomed trails then they should designed those ditches only not allow it county wide.

where in the ND Century code does it state that one is only allowed to travel the center of a Right of way ? If they do close any portion of the right of way it would have to be closed for all and not open for a select few.

Because club spends the time and money to groom the trails the sxs wreck the trails. I dont know why people drive them in the ditch any way why not use the road. Best part is backing out of the heated garage down the high way and on the lake in the winter.

Under 24-07-03 where it says that a section line or portion can be closed for numerous reasons. One of which being a "readily accessible alternative route". I think this allows them to close ditches to travel since there is a improved road next to it.

Just to be clear I wasn't saying they should close it, but to make a trail system that can handle the traffic and designate it for this purpose in certain areas.

No different than a county paving a road when the traffic gets too much for gravel maintenance.

Most of those driving are kids not adults. In nd a kid , I believe 12 yrs old can drive off road but Since they are 12 they are not capable to obtain a drivers license to drive on the road. These kids are coming out of subdivision to ride their motorcycles, Atvs, and UTVs. Did you not have a dirtbike or an ATV is a kid that you would ride in the ditches? To many people forget what it’s like to be young. This is better than all stealing drinking or doing drugs.

These are mostly kids coming out of the subdivisions and are not old enough to drive on roads or load their vehicles on trailer and drive a vehicle to a designated trail. They’re just kids out having fun just like you probably did when you were a kid.

I have about 800 feet of road frontage ditch that I mow and kids will drive their dirt bikes and four wheelers in the ditch. I will admit I have very little damage, but the damage I have doesn’t bother me in a bit.

We did all over but knew if we rode them on groomed trails we would get an ass wiping but most of us had snowmobiles to so we didn’t want the groomed trails messed up. That was my point about winter time is on groomed trails the tires mess them up. If it’s not a marked trail go tear shit up and full send it.

If the damage in your ditch was bad enough that you couldn't run your mower over it or cause accidents to riders because the ruts are so deep, or experience these "kids having fun" causing even more damage how would you feel about it.

I have all this and more in less amount of road frontage ditch.
