unless mn has changed all guns IE shotguns and rifles had to be unloaded and cased, I got a warning in mn for having my gun case unzipped 6 inches.
north Dakota guns can be uncased but not a round in the chamber.
you would think the cop would know this
not only that bows have to be unstrung if not in a case. talk about full on retard

don't need to be cased/ he was wrong. seeing them out, i'd certainly check to see if they were loaded. people get freaky these days if they see a gun - sad but true. he was citing what he wanted to be true, not the law.

ND: hide them good while within in bigger city limits, pull the blankets/jackets off when out..
MN: have them in gun case ALWAYS.. I have never brought guns into that state, but had a buddy have a couple confiscated for sitting next to him.
Prepare yourself before city limits and never have a piece showing whatsoever in the case of a petty pullover..

Transporting Firearms

Transporting a Firearm in a Motor Vehicle

The general law pertaining to transporting a firearm in a motor vehicle stipulates that no person may transport a firearm in a motor vehicle unless the firearm:
· is unloaded and in a closed gun case expressly made for that purpose;
· is unloaded and in the closed trunk of the motor vehicle; or
· is a pistol carried in compliance with the carry permit requirements of the Gun Control Act.103

There are exceptions to this law for people who are disabled and wish to transport the firearm for hunting purposes in compliance with the game and fish laws.104, 105

Under Minnesota law, it is not necessary for a firearm being transported in the closed trunk of a motor vehicle within Minnesota to be enclosed in a gun case. Casing is required when transporting a firearm within the passenger areas of the vehicle.

The general law is that a firearm must be unloaded when being transported in a vehicle, unless it is a pistol being carried in accordance with a valid permit to carry.

The 2009 Legislature amended the game and fish laws to allow an uncased, unloaded rifle or shotgun to be transported anywhere within a motor vehicle in the following specific situations:
· while at a shooting range, where the person has received permission from the lawful owner or
possessor to discharge firearms
· while lawfully hunting on private or public land, as evidenced by possession of a valid hunting
license (if required for the person for the species being hunted)
· while traveling to or from a site where the person intends to lawfully hunt that day or has
lawfully hunted that day

Ok heres my story and question. Driving around Bismarck yesterday, I was pulled over for having a brake light out. I had 2 rifles in the front of my truck, uncased but unloaded, in the passenger seat. Cop was nice and just gave me a verbal warning but mentioned that you arent allowed to have uncased rifles in your vehicle. He said they are required to be cased and kept in the back of the vehicle, back seat or box/trunk. I told him I have a CC permit and he said, that doesnt matter, those arent concealed. I told him I had never heard of that requirement, but I didnt push it, cuz hes a cop and dont want things to go the wrong direction with cops. He just said it was FYI he told me about it, but he said if the wrong cop pulled me over, it could be an issue... So whats your guys opinion on this? Ever hear of a rule requiring guns to be kept in a case while being transported in a vehicle?

As someone already stated, the officer is wrong. Rifles and shotguns uncased in the vehicle are fine. They have to be unloaded, and many are confused about this also. Loaded means a round in the chamber, if the chamber is empty but there are rounds in the magazine, the firearm is not loaded. And a city, Bismarck, Fargo, Minot, doesn't matter which one, cannot make a local ordinance that is stricter than state law.

62.1-01-03. Limitation on authority of political subdivision regarding firearms. A political subdivision, including home rule cities or counties, may not enact any ordinancerelating to the purchase, sale, ownership, possession, transfer of ownership, registration, orlicensure of firearms and ammunition which is more restrictive than state law. All such existingordinances are void.

I own a benelli and you can have one in mag and one in "no man's land". Asked the game warden if this was considered in the chamber. The answer was technically no. Asked if I would be cited. Answer no.
Now what if you two in the mag and one in no man's land?;:;boozer

City ordinances on firearms are more or less nullified by state law. If city cops cite city ordinance, explain that NDCC 62.1-01-03 states he can suck a golf ball through a garden hose but he can’t twll you what to do with your guns. Also insult his mother for good measure.

62.1-01-03.

Inadvertently let the old CC expire, and am not sure iffn I have the gumption to sit through another class.
With ND being a state not requiring it, now what?

Is there a reason to sit through another class. I have a pistol with me most of the times in the vehicles.

For firearms purchases you skip the background check with a CCP.

If you want another CCP other than a ND you first need an ND.

If you don't go out of the state much, other than those two reasons, I probably wouldn't sit through another class.

These are the two reasons I did the class 1. my class 2 expired, and the class 1 has reciprocity with more states than the class 2... it really wasn't that bad of a class either... just a couple hours and some range time...

Do you have to qualify every year with a Class 1? I can't remember and I'm too lazy to look it up.

If so, I would never be able to sustain that type of commitment. lol

You might save yourself a $ 20.00 fine if you forget you have a gun in the vehicle and or don't inform the officer of the gun in the vehicle.


62.1-04-04. Producing license upon request - Penalty. 1. Every individual while carrying a concealed firearm or dangerous weapon, for which a license to carry concealed is required, shall have on one's person the license issued by this or another state or a digital image of one's concealed firearm or dangerous weapon license issued by this state on an electronic device and shall give it to any active law enforcement officer for an inspection upon request by the officer. The failure of any individual to give the license or digital image of the license to the officer is prima facie evidence the individual is illegally carrying a firearm or dangerous weapon concealed. 2. Every individual carrying a concealed firearm under the authority granted in subsection 2 of section 62.1-04-02 shall inform a law enforcement officer of the individual's possession of a concealed weapon upon the initiation of a traffic stop or any other in-person contact initiated by a law enforcement officer. 3. Every individual carrying a concealed firearm under the authority granted in subsection 2 of section 62.1-04-02 must have on one's person a valid driver's license or nondriver identification card issued by the department of transportation or a digital image of one's valid driver's license or nondriver identification card on a mobile device and shall provide the license or card to any law enforcement officer for inspection upon request by the officer. 4. An individual who violates this section is guilty of a noncriminal offense punishable by a fee of twenty dollar


62.1-04-02. Carrying concealed firearms or dangerous weapons - Licensedistinctions.1. An individual, other than a law enforcement officer, may not carry a firearm ordangerous weapon concealed unless the individual is licensed to do so or exemptedunder this chapter.2. An individual who is not otherwise precluded from possessing a class 2 firearm anddangerous weapon license under this chapter and who has possessed for at leastthirty days a valid driver's license or nondriver identification card issued by thedepartment of transportation may carry a firearm concealed under this chapter.3. An individual may carry a firearm concealed under this chapter if the individualqualifies for reciprocity under section 62.1-04-03.1 and the individual has theequivalent of a class 2 firearm and dangerous weapon license from the state in whichthe individual is a resident.4. For purposes of this chapter, the difference between a class 1 and class 2 firearm anddangerous weapon license is only the extent to which a holder of either license may beeligible to receive reciprocal rights in other jurisdictions. I just picked up a "Piece" the other day and my license was expired as well. Dude man running the counter said one good reason to keep it is because when you pick up said "piece" he doesnt have to call it in to the govt. There is no record of the purchase. :;:huh

If your buying from a FFL you still need to fill out a 4473 form. That is on all guns from a FFL holder.


Doesn't matter if you have a CC permit.

What happens if one were to get pulled over and somehow got searched for some dumb reason and they look over the weapon. Lets say said weapon has no serial numbers. Whats the penalty for that? Asking for a friend.
