Yes Eyexer, by all means let's make it more of a hassle for landowners to post land and give free roam to lazy hunters that can't take the time to track down a landowner. That will go over really really well. This last legislative session the Legislature was close to changing the trespass law, but thankfully was defeated. There were quite a few votes to pass it through. I can almost guarantee that it will come up again. If the intent to post is there then don't hunt it without permission. Respect private land and the gates may open. Trespass on private land because the signs aren't up to your liking, the trespass bill will keep coming up and it will be passed.

No Way!!! Nothing technical about a posted sign. I've had the same signs up for 12 years, does that make them less valid than new ones?? Do some homework and find the owner to ask permission. Think of it this way, There is always that last straw that breaks the camels back. In this case landowners tolerace for slob hunters. Do the right thing and DON'T be that straw. Otherwise, the next step is a SD style land usage where everything is automatically posted and I for one don't want that.

I don't hunt without permission if it's posted.
The one (problem???) that I run across is when deer season is over and I am coyote hunting. All the posters are still up for deer season so it can be impossible to hunt coyotes sometimes. A guy is pretty damn sure that 99% of the landowners don't care if you shoot a coyote but I haven't contacted them so I don't hunt. Coyotes can cover allot of ground and so can a guy hunting them. I've always wondered how to fix this?

The trespass bill will keep coming no matter what you, eye, or any other sportsman do as some in the legislator are determined to get it passed. They will keep shoving it down our throats until they finally get what they want, they did it with Sunday blue laws and seatbelts years ago just to name a few. What needs to be passed is a law that prevents bills from being brought up year after year even though they have been previously voted down, wasting the legislators time . Maybe a 6 or 10 year waiting period for bills with similar intent or once it is voted down similar bills would require a 2/3 majority vote instead of a simple majority.

The thing people fail to consider is if that happens funding for the game and fish will have to come from the general fund. License sales will plummet.

I would not hunt it and I don't believe others should either but it certainly is a fuzzy area. If the land has changed hands several times it's very possible they were from a previous landowner. One of the requirements of both the hunting trespass and criminal trespass statutes is that signs must give the name of the person doing the posting and it must be legible. There is a section that allows prosecution if the landowner was "in substantial compliance" with the posting requirements. A valid argument could be made that unsigned posters are not in substantial compliance because the intent of the law is to notify individuals hunting is not allowed without permission but also to give the name of the person doing the posting so asking permission of the person doing the posting is feasible. Again, I wouldn't hunt it and I would encourage others not to as well but if you're a landowner and you want to post your land and are willing to prosecute people you do trespass, why not comply with the requirements instead of taking a chance. I'm amazed how many signs I see without names on them and wonder why people wouldn't just take the few minutes to put their names on them.

I think someone is trying to get everybody here to agree with what he wants to do, even though he knows it's wrong.

The signs are "old". Who cares? If there are signs, there are signs. Who is to judge whether or a not a sign is old, or is "difficult to read"? Seems to me that this "I wish there was more gray area, so I could justify breaking the wishes of the landowner" is why landowners post so much.

So if I decide I want to go on a camping and fishing trip in say Bismarck to fish the river can I just set up a tent area in some ones yard near the river. Because I am pretty sure there are no signs saying I can't in their front yard, I just want to fish a little.

Close enough. I didn't really care for stopping to clean up garbage while out fencing either after finding someone's camping spot on our land either, within 1/4mile of the farm house. Not saying there are a lot of bad apples out there just giving my point of view that I have formed from what I have dealt with over the years.
On the flip side I have also had people stop or call to let us know they found a damaged fence or a tree on it or one blocking the road, believe it or not some will actually come help if you are going out right away. There are a lot of good apples and a few bad I view an in town property no different than my out of town property. Treat out of town property with the respect you expect in town and it is amazing how well people can get along.

Doing some looking around for deer tonight and went to some land we hunted quite a few years ago, mostly just a nice evening for a drive. We stopped hunting this property when it changed hands and new owner didn't let any one on. Land has changed hands a couple more times and have no idea who owns it now just know they do not live in the area. The question for you is as follows; the land is posted with signs that are two or more years old based on the condition of the signs. You cannot make any info on the landowner so IMO this is not legally posted. However the intent is quite clear. I have always avoided land like this cuz I just don't need the trouble but this line is a little fuzzy to me- how many would keep driving and how many would stop to hunt? Thanks TW

So if the land has changed hands and the new owner does not live around there and the signs are from previous owner you should probably help the new owner out and remove the old signs for him…seems like the neighborly thing to do … :;: or am I ... nope definitely :;: or not :;:
