Hunting 'Unposted' Private Land

GNF had to talk the asshole out of pressing charges against the two kids. $350 fine and loss of hunting/fishing/trapping privs for one year. Thats a low blow!
Is loss of hunting privileges automatic in this situation? Do they first need to be convicted of illegally trespassing before losing privileges?

I apologize for thinking your were projecting your feelings. I have no problem with anyone hunting the public land or using the law to get there. As I said sometimes a heads up is nice that someone is walking through mine which isn’t open country for a lot of it so not easy to see someone all the time to get there to hunt. A lot of people have contacted me and some don’t and that’s fine there is nothing that says they need to. I would more so be concerned about someone retrieving wounded game which could put them anywhere on the property and I really feel that is where a heads up should be warranted and more beneficial. I’ve never said no to those that have asked about retrieving deer in fact a lot of times if I’m around I’ll help them get to them. I think this has spiraled downhill a lot and unfortunately with a lot of things hunting I don’t see it getting any better.

Kids don’t own land. Guy takes his kid out and he hits his first buck a little low and it dies in the next pasture. Dad calls the owner and old man Scrooge just happens to answer and chews his ass. Dad and kid have to walk away with the buck in sight. Some guys are never going to own land. Some don’t want to bother anyone or be bothered. One more thing to make them hang it up. The rules in place work just fine for everybody.

I agree, no more laws are needed. Rarely do laws seem to actually benefit the most anymore and not just the loudest criers. I don't agree with weaver that there needs to be a law, dad always said locks only keep the honest people out. A lot of me discussing in this thread is something thats happened to me and me pointing out how no knowing someone is on private land without knowledge can pose some issues. I will be blatantly honest and say generally it's not the people i don't know who cause issues for me as a landowner it's the ones i do know and they think "oh he won't care".

1. Walked a section line to get to public land - no issues
2. Retrieving game on road right away - my experiance is most of them were shot from road right away - in others shoot and be fast retrieving.
3. Public land - IMO less people actually walk in Most sit on the road and wait for me to push one to em.
4. Full permision to hunt a relatives land and sure enough the neighbor comes and says you cant hunt this and that no my relative does not own this - gets me off the land - then i call and find out no its the land that i was given permision to hunt.

This thread is nothing more than a BIG WEDGE between landowners and outdoors people(hunters, fishermen, photographers, hikers, etc.). The law is the law...except is as it is. Tresspass for retreival is a legitamet solution for both sides, with the law definig the limitations. Quit the bitching on both sides of the fence...pun intended!
Incorrect. This thread is someone coming here with a very isolated issue and or sent here by a group with an alternative motive or to create an issue where there isn’t one. Most here rejected the very idea and notion brought forward including many of landowner/members in this board and I’d say a lot was accomplished in hammering down the message of being respectful on both sides of the issue and we will all be just fine

Not sure what you mean. A professional sign with clear legible lettering I think is best. Some of the signatures I see are not readable
The big metal orange signs, there all over the fricken place. Just about "zero" signatures on anything, apparently to difficult or above the law.

So once again not looking to start an argument but share my experience. The big metal orange signs are the same ones I have on my property. The permanent marker is far from permanent on them and it would wear off every year pretty much it seemed. Once e-posting became legal that’s the way I went just for the ease. My signs are still up o just don’t have to go sign them every year so I don’t. That’s just me though.

Not a problem there. Ever since the change from the 440 rule it has become a shit show for posting Partial posting, only an old piece of paper of an old no hunting sign on the gate or corner post flopping in the wind ( but you know the intent ).

I have had 4 incidences in the past 5 years with this law being used as an excuse for their activity. I don't know how many others I didn't catch or find out about. You may find that hard to believe but I find it equally hard to believe that no other landowner on this forum/state hasn't had this happen to them.
I don't know if their behavior stems from opportunity or spite but that doesn't matter, just the fact it does happen. I'm sure they are just as cleaver in the rest of the state as here.
The fact from my personal experience is the law ( although well intended) has been circumvented by many in this area to either shoot over fence lines to retrieve ( in hopes act wasn't witnessed) to enjoy a free retrieval without question or The act of dropping party members at property lines to flush an area known to contain game animals to either disperse to outside legal area or to waiting party members.
A landowner under this current ruling has no idea when he crests the hill and is surprised to see people on his posted property as to whether he has a trespass situation or a simple retrieve .
It's unsettling to a lot of landowners when this occurs.
It's can be unsettling to other hunters as well when they encounter others in the field that they had no idea might be there whether it be a landowner/family hunting or single permission parties.
A law is supposed to be balanced for the good of all...this one has a 100 lb weight on one side and nothing on the other.
I do everything by the book regarding posting. Clear legible signs/signed sometimes even dated placed at required distances/borders etc. It just gives them something to read when they walk past them. With the current law it has been made easy to do.
Why can't we as landowners know who you are ? You know us.
This law made up just for the extremely rare occurrence ( from feedback here some in 40 years some 50 +) has never had it happen to them where they had a need to access. And the reduce the ratio even further we know most landowners will gladly give permission or even assist them in a legal harvest. A law for the equally rare occasion when a 1 in 1000 landowner might not be obliging. Wow . Aren't you the one engaging in your hobby? Shouldn't you be the one reaching out with some effort to contact landowners ( so they aren't getting surprises) ? If no contact can be made couldn't any form of law enforcement assist with contact. Most have quick access to locating owners, or so they may record names /details in case a request for investigation in matter is sought.
No Sorry Trip; The abuse of this law will continue for me and some of my farmer friends unless a fair solution to all is reached.

And again to reiterate you seem to have an isolated area of incidents. The proper recourse at this time seems to be to gather information on individuals and let law enforcement investigate. The proper channels and law are already in place to take action. It seems to me you aren’t wanting to take that avenue for whatever reason

So as much as i hate saying it but sometimes landowners need to be assholes and the law needs to punish people. Now we don't need over the top like the whole corn fiasco. I remember as a dumb kid hunting and not being the law follower i am now that you didn't even think about doing anything near the "asshole" landowners because you knew you would get in trouble and that it could be more than a butt chewing. Like i mentioned earlier i have some leeway for young and dumb but when you are old enough to for sure know better it's time to get punished and maybe some of this will stop. Our game wardens are spread thin and sometimes they don't want to deal with situations. Friend of mine had people using the section line rule to access public land but they weren't following the section line since it ran through a big nasty draw so they would walk around the end of the draw. Game warden wanted nothing to do with it.

I do gather as much information I safely can. It's not easy approaching 3 pickups full of heavily armed people all by yourself unarmed looking for evidence/plates etc.
I have had law enforcement involved 3 of the 4 times. One resulted in a conviction because the evidence was to overwhelming to dispute, one resulted in a warning. The other the pickup tore out so fast it resulted in a semi-high speed chase into town as he knew I was trying to get his plate. I contacted the Sherriff to look at cameras footage from convenience store. We also went to farm location looking for evidence. So yes anytime I encounter this I do contact law enforcement but this does nothing to solve the issues I spoke of

Like I said back during the E-posting days, why not just give the current laws some teeth. Make the minimum punishments actually hurt instead of lame States Attorneys and judges letting them walk?

Where are you located? It sounds like you are near the ok corral? The fact that you have that many incidents tell me either you have a ton of 200” deer on your land where normal people lose their minds to get….. or you are completely exaggerating the entire situation. Likely for a cause.

How did you get a conviction and a warning if these people weren’t breaking the law?
