My bad, I didn't watch the video (can't, I'm at work and it's to loud) I assumed the premise is that prosecutors are trying to hem folks up who were in a defensive shooting situations using hollow point ammo arguing that death (murder) was the intent. I've also read that being less than lethal in those situations can get you hemmed up as well.
