Actually... that "asshole" farmer DID put the signs up the evening before. Unfortunately farmers are incredibly busy with harvest and don't always make it to a store to buy and get the signs up right away to make your lives easier. BTW I was on the phone with him when he was supposedly just putting the signs up and he was saying "what the hell, don't they see me" thinking they would come to the pickup and he would ask them to leave, but they never did, hence the game warden showing up. Even after all the trespassing, stealing, littering, destruction of property... he has put up with over the years, he tried getting a hold of the states attorney to drop the charges (realizing it could have just been a mistake that they missed the signs), not sure if he will try again.


so I am confused? you're saying you talked to the guy that posted the property? but he put them up the night before...however you were on the phone with him when he was doing it and the family was hunting in the field while he was posting it? did he do it in the evening or when they were in the field ? seems like a guy must be pretty passionate about posting land if he can't even find time to pick up some signs when he's in town? ... didn't have last year’s signs laying around ... I feel your newly joined status and story inconsistencies are not even remotely helping the matter ... that is if you truly are the LA-LA that the land owner spoke to

When is the best time for farmers to put up no hunting signs if they allow bird and furbearer hunting but not deer hunting ?

get permanent signs made up that say NO TRESSPASSING from Nov 1st through Nov 30th and leave them up year round. By having metal signs made up they will cost up front but you would save money and time for many years

I think you missed the word "supposedly" and the part where I said "he DID put the signs up the evening before"
The first post basically said the land owner got out of the pickup to hang up the signs after the hunters were already on the land and it didn't happen that way.

I know it is a bit off topic to this specific discussion and I posted it in another thread, but there is a case in Stark County about animal cruelty that may influence another run at the all land is considered posted law.

The judge in that case ruled that because the out buildings and corrals of the ranch (a business) were 60 feet away from the house, law enforcement did not need a search warrant ot enter them. A factor also seemed ot be the property was not posted.

I contacted my legislators opposing the trespass law last time, but if this is the precendence set from this case I would support it this go around.

I thought prior to searching someones business law enforcement needed a warrant? If they can enter ag production business facilities without a warrant if land is not posted that is going to get a lot of people thinking.

I Find the "no time to hang signs" excuse pretty pathetic... there is always time. What do you do for the 9 months out of the year you aren't in a tractor/combine?

Well according to Kurtr, we've GOT to keep this going until we PISS OFF everyone in the state, so here's my contribution to the Butthurt. Hunting is important to me, everyone knows this and as such I make a point to KNOW where the game is and where I can and can not hunt. It's called SCOUTING. In my experience, a large portion of these types of situations occur when hunters just go hunting and when they get to wherever they are going they discover posted signs on everything they want to hunt. Then, after burning a tank of gas driving around and getting more and more frustrated at seeing the signs, they start debating "Is this legally posted" or "We can just jump out, blast a couple, and be gone before anyone notices" or "Well I didn't drive all this way to not shoot something, so F the signs". When the reality is that all it takes is a couple of trips to find locations to hunt, make the effort to locate the landowner, and just ask to hunt. From what I've encountered, 90% of the posted signs are for DEER. Another 5% is for pheasants, and the remainder are just to keep folks out. I have only been turned down to hunt waterfowl a handful of times and those were because family was going to hunt. Late season pheasants (after rifle season) is fairly easy as well. It's the advice of this greybeard, that a couple of cruises to an area and a handshake or two BEFORE, BEFORE, BEFORE the season opens will do wonders for the relationships between hunters and landowners. I am a landowner as well as a hunter so I've been on both sides of the fence on this deal and I can say without reservation that PISS POOR PLANNING on the hunters part causes the majority of these issues. I say this because landowners are landowners 24/7/365. Hunters are hunters three to 5 weekends a year. Bash me if you want, but this is what I've come to know. Carry On!!!

Maybe in that case . My neighbor had a guy give him the - I wounded a deer excuse last yr but He called sheriffs office anyways and he got charged n convicted for criminal trespass $125 fine . Gf needs to take the part out about being able to get a wounded deer on posted cuz it ain't true . Criminal side of it trumps the gf side . U go on to get a wounded deer without permission and guy has no trespassing signs up your screwed

The law is pretty clear in that the hunter has the obligation to try and recover a wounded/dead critter from posted land or they are running the risk of getting a "wanton waste" violation. In this example, if you ask the landowner to allow you permission to seek a wounded animal, you need to get a warden/sheriff involved. They will escort you onto the private land to retrieve the animal.

On a somewhat yet not related topic does anyone know where people are getting those permanent orange no trespassing signs? The orange ones. That seem to literally be everywhere.

In this example, if you ask the landowner to allow you permission to seek a wounded animal, you need to get a warden/sheriff involved. They will escort you onto the private land to retrieve the animal.

Bullsh't ..... yeh the g&f law ..... but even if warden comes and says yes you can go get deer me as landowner can call sheriff and you will get criminal trespass . The criminal law for trespassing trumps gf guarantee u

Why do you think one law automatically trumps another? If I was recovering a deer shot in a place I legally had a right to be and didn't have a weapon with me when I did it, I like my chances in court IF I ever got charged. I don't think a reasonable state's attorney would take that to court.
